20th March 1802.
This is the Last Will and Testament of me Margery Gilbert of Uttoxeter in the County of Stafford Widow. First I direct the payment of all my just debts and funeral expenses by my Executors hereinafter named out of my personal Estate; Also I give and devise all those two Closes, Pieces, or Parcel of Land situated lying and being in the Parish of Uttoxeter aforesaid, on the left hand side of the road leading from Uttoxeter to Woodgate, now in the Occupation of Joseph Summerland, being part of the Lands devised to me by my late Uncle Mr. Robert Towers unto John Smyth of Woodlands Hall, in the Parish of Uttoxeter aforesaid, Gentleman, his Heirs and Assigns for ever; Also I give and devise all those other Closes, Pieces or Parcels of Land situated in the Parish of Uttoxeter aforesaid, called the Bank Close, and the Bag Meadow; also in the Occupation of the said John Summerland, being the remainder of the Lands devised to me by the said Robert Towers unto William Lowndes of Congleton, in the County of Chester, Gentleman, his Heirs and Assigns for ever, the said William Lowndes paying unto my Executor hereinafter named the Sum of One Hundred Pounds for the use of his Sister Ann, the Wife of Edward Mallabar, of Uttoxeter, and Edward Lowndes her Son as hereinafter mentioned; Also I give and bequeath unto my Executors hereinafter mentioned the Sum of Four Hundred Pounds upon Trust that they or the Survivor of them his Executors or Administrators do and shall pay and apply the Interest dividends and produce of the Sum of One Hundred Pounds, to be paid to them by the said William Lowndes, to the said Ann the wife of the said Edward Mallabar, until Edward Lowndes their Son attains his age of Twenty One, And when the said Edward Lowndes Mallabar shall attain his said age upon Trust to pay the said sums of Four Hundred and One Hundred Pounds to the said Edward Lowndes Mallabar; And in the case of the death of the said Edward Lowndes Mallabar within his said Age, upon trust that my said Executors or the Survivor of them do and shall pay the said several Sums of Four Hundred Pounds, and One Hundred Pounds to my said Niece Ann the Wife of Edward Mallabar, her Executors and Administrators; Also I give and bequeath unto my Executors hereinafter mentioned the Sum of Six Hundred Pounds upon Trust that they or the Survivor of them his Executors or Administrators do and shall pay and apply the Interest dividends and produce thereof during the Life of my Brother Robert Wheeldon to and for the benefit of my Said Brother Robert at such times and in such proportions manner and form as my Executors shall judge best for his advantage And after his decease, upon Trust that my said Executors do and shall pay and divide the said Sum of Six Hundred Pounds to and amongst my Nephews and Nieces the Children of my said Brother Robert in the proportion and manner following that is to say to Stephen and Elizabeth Wheeldon the Sum of Fifty Pounds a piece and the remainder thereof equally amongst their Brothers and Sisters, as and when they respectively come of age, paying and applying the Interest thereof in the mean time for their benefit and advantage; Also I give and bequeath to my said Nephews and Nieces the children of the said Robert Wheeldon, the Sum of Three Hundred Pounds to be equally divided amongst them as and when they Respectively attain the age of Twenty One years, my Executors applying the Interest of their respective shares in the mean time for his her and their benefit; Also I give and bequeath to my Sister Mary Wheeldon the Sum of Fifty Pounds. Also I give and bequeath to Mr. Charles Smyth of Uttoxeter aforesaid, Gentleman, the Sum of Fifty pounds the said two Legacies to be paid within Six Months after my decease, Also I give and bequeath to my said Brother Robert the Sum of ten Pounds to buy Mourning; Also I give and bequeath to the Poor of the Township of Uttoxeter, the Sum of Twenty Pounds to be distributed at the discretion of my Executors; Also I give and bequeath to my Nephew Robert Wheeldon my Silver Pint cup which was my Father’s; All the Rest Residue and Remainder of my Estate and Effects whatsoever wheresoever and of what nature or kind soever I give and bequeath to the said William Lowndes and Ann the wife of the said Edward Mallabar, equally to be divided between them; And lastly I do nominate and appoint the said John Smyth and the said William Lowndes and Edward Mallabar Executors of this my Will hereby revoking all former Will and Wills by me at any time heretofore made declaring this to be my last Will and Testament. In Witness whereof I have hereunto set my Hand and Seal this Twentieth day of March, in the Year of Our Lord One Thousand Eight Hundred and Two.
